ORDER

This Criminal Original Petition has been filed seeking a direction to the respondent Police to comply with the order passed in Cr.M.P.No.1 of 2025 in Crl.M.P.No.20 of 2023, dated 22.04.2025, on the file of the learned Judicial Magistrate, Sankarankovil, Tenkasi District, by registering an FIR in accordance with law, based on the complaint given by the petitioner on 09.07.2022.

2. The petitioner lodged a complaint before the learned Judicial Magistrate, Sankarankovil, which was forwarded to the respondent Police. The grievance of the petitioner is that even after the direction of the learned Judicial Magistrate to enquire into the complaint, no effective enquiry has been conducted by the respondent Police.

3. When the matter was taken up for hearing, the learned Government Advocate (Crl. Side) submitted that the complaint forwarded by the learned Judicial Magistrate was enquired into by the respondent Police and closed on 05.05.2025, and that a closure report has also been filed before the concerned Judicial Magistrate.

4. The learned counsel for the petitioner, however, contended that the proposed accused in the complaint are Police Constables serving in the same Police Station and, therefore, the respondent Police had deliberately closed the complaint without conducting a proper enquiry.

5. Considering the submissions on either side and in view of the fact that the complaint, dated 09.07.2022 has already been enquired into and closed by the respondent Police on 05.05.2025, this Court directs the respondent Police to furnish a copy of the closure report to the petitioner, so as to enable him to work out his remedy by filing a private complaint before the concerned Judicial Magistrate, if so advised.

6. With the above direction, this Criminal Original Petition stands closed.
