Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to transfer the investigation in connection with Crime No.327 of 2024 from the file of the 3rd respondent to CBCID/4th respondent or any other independent investigating agency under the supervision of the 1st Respondent and consequently take necessary action within a stipulated period as may be fixed by this Court.

ORDER

The petitioner seeks to transfer the investigation in connection with Crime No.327 of 2024 from the file of the 3rd respondent to CBCID/4th respondent or any other independent investigating agency under the supervision of the 1st Respondent and consequently take necessary action within a stipulated period as may be fixed by this Court.

2. When the matter is taken up for hearing, the learned Government Advocate(Crl.side) on instructions, would submit that after 2/4

completion of investigation, the final report has been filed as 'mistake of fact' and RCS notice has also been served on the petitioner.

3. In view of the above, this Criminal Original Petition is closed with liberty to the petitioner to challenge the final report, by filing a protest petition in accordance with law.
