ORDER
This writ petition is filed seeking a direction to the third respondent to issue Patta in respect of New Survey No.164/2 (Old Survey No.23), to an extent of 6 acres and 23 cents, situated at Sooriyur Village, Thiruverumbur Taluk, Tiruchirappalli District, on the basis of the petitioners' representations dated 24.08.2024 and 13.11.2024, within a time frame to be fixed by this Court.
2. Heard the arguments of Mr.T.Vadivelan, learned counsel for the petitioners, and Mr.A.Baskaran, learned Additional Government Pleader, for the respondents. By consent of both sides, this writ petition is taken up for final disposal at the admission stage itself.
3. According to the petitioners, the subject property was purchased by them under a registered sale deed dated 22.08.1963, bearing Document No. 4175 of 1963, on the file of the Joint Sub-Registrar No.II, Tiruchirappalli. The said property was taken over under the provisions of the Land Reforms Act by G.O.Ms.No.1026, dated 19.04.1979. However, the said Government Order was set aside by this Court in W.P.No.25709 of 2014. Pursuant thereto, the third respondent passed orders on 13.09.2013 and 16.12.2013, directing change of patta in the name of the petitioners. The said order was 2/5
challenged by one Manoharan in W.P.(MD) No.10013 of 2014, which came to be dismissed by this Court, holding that the petitioner therein had failed to establish his right over the subject property. Thereafter, the petitioners submitted a representation on 13.11.2024 before the third respondent, seeking mutation of the revenue records in their favour. Since the said representation has not been considered, the petitioners have approached this Court.
4. The learned counsel appearing for the petitioners would submit that, in spite of the orders passed by this Court in W.P.No.25709 of 2014 and W.P.(MD) No.10013 of 2014, the respondents have failed to consider the petitioners' representation and pass necessary orders for mutation of the revenue records.
5. The learned Additional Government Pleader, who takes notice for the respondents, would submit that the representation submitted by the petitioners will be considered in accordance with law.
6. In view of the above submissions, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the petitioners' representation dated 13.11.2024, in the light of the orders passed by this Court in W.P.No.25709 of 2014 and W.P.(MD) No.10013 of 2014, and pass final orders on its own merits, within a period of twelve 3/5
weeks from the date of receipt of a copy of this order, after issuing notice to the petitioners as well as the person in whose name the patta presently stands. Accordingly, this writ petition stands disposed of. No costs. 20.08.2025 NCC : Yes/No Index : Yes/No Internet:Yes skn To 1.The District Revenue Officer, Trichy District, Trichy.
