RAYER C.R.P.(PD)(MD).No.528 of 2018: Petition filed under Section 6 (B) of Tamil Nadu Cultivating Tenant Protect Act read with 115 of CPC, pleased to set aside the order dated 17.02.2017 passed in I.A.No.126 of 2014 in I.A.No.44 of 2014 in T.C.T.P.No.1 of 2008 on the file of Revenue Court, Special Deputy Collector, Madurai and allow the present Civil Revision Petition.

ORDER

The petitioner is a landlord while the respondent is a tenant. The petitioner herein had earlier filed C.R.P.(PD) (MD)Nos.527 and 528 of 2018 before this Court . C.R.P.(PD)(MD) No.528 of 2018, filed by the petitioner herein was allowed by order dated 30.10.2018, since admittedly the tenant did not remit the rents which he was required to do in I.A.No.126 of 2014. The grievance of the petitioner is that the tenant is now seeking to adduce evidence before the Executing Court as if he had complied with the direction made in I.A.No.126 of 2014. I am of the view that this will not in any way constitute contempt of the order passed by this Court. It is for the petitioner herein to bring to the notice of the Executing Court about the order passed by this Court in C.R.P.(PD)(MD)No.528 of 2018 on 30.10.2018.
