This Writ Petition has been filed in the nature of Mandamus seeking a direction to the first respondent to dispose the appeal, dated 23.03.2018 by considering the report submitted by the second respondent in Na.Ka.No.2525/2016/C, dated 27.06.2016 and consequently, to cancel the patta granted in favour of the respondents 3 to 11.

2.There is no representation for the petitioner. Heard Mr.N.Satheesh Kumar, learned Additional Government Pleader for Respondents 1 and 2.

3.My attention is drawn to the earlier Writ Petition filed as https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.21641 of 2021 Public Interest in W.P.(MD)No.2652 of 2011 filed by the very same petitioner, wherein, a direction was sought against the respondents 1 to 3 therein to remove the alleged encroachment of the private respondents, who are also shown as respondents in the present Writ Petition. An order was passed that no direction can be issued, except granting opportunity to the petitioner to challenge the patta issued to the private respondents therein. 4.In the said Writ Petition, the relief sought was to dispose of the appeal, dated 23.03.2018 by the second respondent and to cancel the patta granted in favour of the very same private respondents. The same relief is sought in the present Writ Petition.

5.The learned Additional Government Pleader also pointed out that the petitioner has filed this Writ Petition as a person interested, but has no direct interest. He is not connected with the property.

6.In view of all these findings, the Writ Petition is dismissed. I am confident that the second respondent may dispose of the appeal in manner known to law even without any direction from this Court. No costs.
