PRAYER: Habeas Corpus Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondent Nos.1, 2 and 3 herein to secure and produce the body or person of the detenu namely minor Sri bhavan Viswanth, S/o.Mathan Kumar, aged 3 years before this Court and hand over the custody of the petitioner and to secure and protect her child from the fourth and fifth respondents.

ORDER

(Order of the Court was made by A.D.JAGADISH CHANDIRA,J.) This Habeas Corpus Petition is filed for a direction to the respondent Nos.1, 2 and 3 herein to secure and produce the body or person of the detenu namely minor Sri bhavan Viswanath, S/o.Mathan Kumar, aged 3 years before this Court and hand over the custody to the petitioner and to secure and protect her child from the fourth and fifth respondents.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 3.When the matter is taken up for hearing today, the learned counsel appearing for the petitioner would submit that since the fourth respondent had taken the child, the petitioner had lodged a complaint before the respondent police. Pursuant to which, the respondent police have secured the child and handed over to the petitioner and hence, he seeks the matter may be closed. 4.The learned Additional Public Prosecutor appearing for the respondents would submit that the fourth respondent is none other than the husband of the petitioner. Based on the complaint given by the petitioner, the child has been secured from the fourth respondent at R.V.Nagar and now were kept in One Step Centre.

5.Today the petitioner and the child have been produced before this Court. The petitioner submitted that the child had been handed over to her. 3/5
