PRAYER :- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the 1 to 4 respondents to re-correct the FMB in its original status that the Well and EB connection in the petitioner's share of land in S.No. 97/1C is now wrongly changed in S.No. 97/1B on the basis of representation dated 26.06.2025 within the time stipulated by this Court. O R D E R
This writ petition has been filed seeking a direction to 1 to 4 respondents to re-correct the FMB in its original status that the Well and EB connection in the petitioner's share of land in S.No. 97/1C is now wrongly changed in S.No. 97/1B on the basis of representation dated 26.06.2025 within the time stipulated by this Court.
2. Heard the learned counsel for the petitioner, learned Additional Government Pleader for the respondents 1 to 4 and learned counsel for the respondents 5 and 6.
3. The learned counsel for the petitioner would submit that the representation made for rectification of the FMB was not acted upon. 2/5
4. Learned counsel for the respondents 5 and 6 would submit that several documents to be produced before any correction is made in respect of FMB entries.
5. Since a representation is made, the same shall be disposed of within a period of twelve weeks from the date of receipt of a copy of this order. However, the contentions raised by the respondents 5 and 6 shall be enquired into and thereafter appropriate orders would be passed on the said representation dated 26.06.2025 on merits and in accordance with law, after hearing all the interested parties and their objections, if any. Needless to say, any dispute regarding title between the parties shall be subject to the jurisdiction of the civil Court.
6. The writ petition stands disposed of with the above direction. There shall be no order as to costs.
