FOR ANTICIPATORY BAIL IN CRIME NO.4/2022 ON THE FILE OF THE RESPONDENT POLICE ORDER : The Court Made the following order :- The matter is listed today under the caption "for reporting compliance".
2. This Court while granting anticipatory bail to the petitioners on 06.10.2022, had passed the following order. "8.Since this matter relates to matrimonial dispute, this Court directs the petitioners/accused persons, defacto complainant and their family members to appear before the Mediation and Conciliation Centre attached to this Bench, Madurai. The Mediator shall conduct the Mediation between the parties for atleast three sittings and to resolve the dispute between the parties. If the petitioners/accused persons fail to co-operate for mediation, the order now passed by this Court will stand vacated automatically."
3. When the matter was listed on 01.02.2023, it was submitted https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD) No.17661 of 2022 by the learned counsel for the intervener that the first petitioner did not appear for mediation, despite there being a direction by this Court to appear for mediation. The second petitioner has appeared once, thereafter, he also did not appear. Further, he would point out the condition imposed in paragraph No.8 of the said order that if the petitioners failed to co-operate for mediation, the anticipatory bail order shall stand vacated automatically.
4. This Court thereby, directed to list the matter for reporting compliance. It is seen that despite obtaining orders, the petitioners did not appear for mediation and failed to comply with the condition imposed by this Court.
5. In view of the above, the anticipatory bail granted to the petitioners on 06.10.2022 stands automatically vacated and accordingly, this petition is dismissed.
