Respondents Prayer: Writ petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari, calling for the records pertaining to the impugned eviction notice bearing letter No.51/Ko-13/Aa.Pa.Pi/Mayanoor/2025 dated 05.08.2025 on the file of the sixth respondent and quash the same as being illegal and untenable in law.

Heard both sides.
2. The petitioner herein challenges the communication dated 05.08.2025 issued by the sixth respondent calling upon the seventh respondent to clear the petition-mentioned encroachments. The 2/6
3 W.P.(MD)NO.21803 OF 2025 petitioner is a trust which is represented by the trustee namely, Thiru.Ragupathi. The seventh respondent Karpagavalli is none other than the wife of Ragupathi. Admittedly, the land in question does not belong to the petitioner. The learned Additional Government Pleader would contest the claim of Ragupathi that he is the trustee of the temple as incorrect.
3. The petitioner had earlier filed W.P.(MD)No.22732 of 2024 claiming patta. This Court disposed of the said writ petition on 25.02.2025 calling upon the Commissioner of Land Administration, Chepauk, Chennai to consider the writ petitioner's request. Pursuant to the said direction, the Commissioner of Land Administration, Chepauk, Chennai vide proceedings dated 17.07.2025 rejected request of the petitioner. It was further ordered that the land has to be recovered. Pursuant to the said direction of the Commissioner of Land Administration, the impugned communication has been issued.
4. When we indicated that since the impugned communication is only a consequential order, the learned counsel for the petitioner stated that questioning the order dated 17.07.2025 passed by the Commissioner of Land Administration, the petitioner has filed an appeal before the Government.

5. It is for the petitioner to obtain interim relief before the Government. We grant 45 days from today to obtain such an interim order. Till then the order impugned in this writ petition shall be put on hold. It shall abide by the order that may be obtained by the petitioner in the appeal before the Government. This writ petition stands disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
