PRAYER :-For Bail in Crime No.115/2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/ A2, who was arrested and remanded judicial custody on 12.09.2022 for the offences punishable under Section 302 of IPC in Crime No.115 of 2022, on the file of the respondent police, seeks bail.
2.There are totally three accused in this case and the petitioner herein is arrayed as A2. The case of the prosecution is that due to previous motive on 10.09.2022 at about 5.00 pm., when Jeganathan was coming from Vettukkattu Thootam to Karudampalayalm by his two wheeler on the instigation of quarry owner Selvakumar one Mahindra pick up van bearing Reg. No. 47 B 2877 dashed against the said Jeganathan, due to which he succumbed to injuries. Hence the case came to be registered. CRL OP(MD). No.17696 of 2022 offence as alleged by the prosecution. He would further submit that due to previous motive he has been falsely implicated as an accused. He further submits that the petitioner is in judicial custody from 12.09.2022, hence he seeks bail.
4. The learned counsel appearing for the intervenor present before this Court and objected to grant bail to the petitioner. 5.The learned Government Advocate(Crl.side) appearing for the respondent submits that investigation is at the preliminary stage. 6.Taking into consideration the gravity of offence and also taking note of the fact that the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.
7. Hence the petition stands dismissed.
