Prayer in Crl.OP(MD)No.14023 of 2019 : - Criminal Original Petition is filed under Section 482 of Cr.P.C. To call for the records pertaining to the First Information Report in Crime No.2 of 2012 on the file of the First Respondent registered under Section 35 of Foregin Contribution (Regulation Act), dated 03.09.2012 and quash the same as illegal.
ORDER:- This Criminal Miscellaneous Petition is coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.M.Muthumanikkam, Government Advocate for the Petitioner and of Mr.Rajiv Rufus, Advocate for the 1st respondent, this Court made the following order:
The above Criminal Miscellaneous Petition is filed seeking orders to extend the time to complete the investigation and to file final report.
2. This Court, vide order dated 18.10.2019, while dismissing Crl.O.P.(MD)No.14023 of 2019, directed the respondent police to complete the investigation and file final report within a period of twelve weeks from the date of receipt of a copy of that order. Subsequently, the time was extended periodically at the instance of the learned Government Advocate (Crl.Side) appearing for the https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD)NO.10920 OF 2021 petitioner/respondent and lastly, this Court in Crl.M.P.(MD)No.5414 of 2021, vide order dated 04.08.2021, has granted three months further time to complete the investigation.
3. The learned Government Advocate (Crl.Side) appearing for the petitioner/respondent would submit that the petitioner has already sent a requisition to the Principal Secretary to the Government, Home Department, Secretariat, Chennai through the Director General of Police, Tamil Nadu, dated 18.10.2019 and that six months time may kindly be granted to complete the investigation.
4. On considering the entire facts and circumstances and also taking note of the fact that this Court has already granted extension several times, this Court is inclined to grant three months time to the petitioner to complete the investigation and file final report. It is made clear that no further extension will be granted.
