Prayer:This petition is filed under Article 226 of the Constitution of India, praying to modify the order dated 31.07.2025 passed in W.P.Crl(MD).No. 768/2025 and permit the petitioner to report before the Othakadai Police Station, Instead of Appanthirupathi Police Station, during the leave period and to allow convict prisoner to either.

Petition filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, to call for the records passed by the first respondent in No.726/Voo.Tha.2/2025 dated 09.07.2025 and quash the same as bad in law and further direct the first and second respondents to grant ordinary leave without escort for the period of 28 days to the convict prisoner namely Vairamuthu, S/o. Panchavarnam (Complainant No.5429) who is life sentenced prisoner in a Murder case and languishing in Madurai Central Prison fo the past 11 years.

ORDER

(Order of the Court was made by the Hon'ble A.D.JAGADISH CHANDIRA J.) This petition is filed to modify the order dated 31.07.2025 passed in W.P.Crl(MD).No. 768/2025 and permit the petitioner to report before the Othakadai Police Station, instead of Appanthirupathi Police Station, during the

leave period.

2.This Court by order dated 31.07.2025 has passed the following order: "Accordingly the respondents are directed to grant ordinary leave to the petitioner's husband for 28 days without escort. During the leave period, the convict prisoner shall appear before the Inspector of Police, Appanthirupathi Police Station, everyday at 09.00 a.m., and 07.00 p.m., without fail." 3.The learned counsel appearing for the petitioner submitted that the petitioner is residing at 5/24, Santhi Nagar, Velliankundram, Appanthirupathi, Madurai North and she had decided to sell the above mentioned property. Hence, the petitioner had vacated the said house and now residing at 4/4, Indra Colony, Arumbanur(Post), Othakadai, Madurai. He further submitted that in order to comply with the condition imposed by this Court, the convict prisoner has required to travel 10kms daily, which causes severe hardship and difficulty. Hence, she seeks modification.

4.Considering the submission made by the learned counsel appearing for the petitioner, the condition imposed by this Court on 31.07.2025 is modified to the effect that the petitioner shall appear before the Othakadai Police Station, daily at 09.00 a.m., and 07.00 p.m., without fail. The other conditions imposed by this Court

if any shall remain unaltered.
