Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to issue a passport in favour of the petitioner by considering his application in File No.MD1065191917125 dated 17.06.2025 as well as petitioners explanation / Representation dated 25.07.2025 within a time limit that may be stipulated by this Court.

ORDER
This Writ Petition is filed to issue a Mandamus, directing the 1st respondent to issue a passport in favour of the petitioner by considering his application in File No.MD1065191917125 dated 17.06.2025 as well as petitioners explanation / Representation dated 25.07.2025 within a time limit that may be stipulated by this Court.
2. Heard the learned cousnel for the petitioner and the learned counsel for the respondent.
3. Learned counsel for the respondents confirm that the petitioner is one of the accused in C.C.No.60 of 2022 before the Judicial Magistrate, Kamuthi, Ramanathapuram District, pursuant to a FIR
registered in Cr.No.446 of 2021 under Section 294(b), 323, 324, 427, 506(ii) of IPC.
4. Considering the above, there is no scope for giving a positive direction to the respondent No.1 to process the application of the petitioner in view of Section 6(2)(f) of the Passport Act, 1967. However, petitioner is at liberty to file a fresh application after securing appropriate orders from the Judicial Magistrate Court, Kamuthi, for processing the passport application before the first respondent.
5. Writ Petition stands disposed with the above observation. No costs.
