For Respondent : Mr.B.NAMBI SELVAN, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C. PRAYER :- For Anticipatory Bail in Crime No.12 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner, who is apprehending arrest at the hands of the respondent police for the offences punishable under sections 406, 407, 409, 417, 418 and 420 of IPC, in Crime No.12 of 2022 on the file of the respondent police, seeks anticipatory bail. 2.The case of the prosecution is that the accused Nos.1 to 5 are the staff of the defacto complainant bank and by using their official power, they pledged the fake gold in the name of others and cheated a sum of Rs.69,90,000/-. Hence, the complaint. 3.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution. He further submitted that as per the confession of the co-accused, the petitioner name was falsely implicated in this case. 4.The learned Additional Public Prosecutor appearing for the respondent police submitted that the petitioner arranged the persons for obtaining gold loan, for which, the petitioner has received the commission a sum of Rs.16,000/- from the accused No.1 and the https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.17922 of 2022 investigation is at initial stage. Hence, he strongly opposed grant anticipatory bail to the petitioner.
5.Considering the above facts and circumstances of the case and considering the fact that investigation is at initial stage, this Court is not inclined to grant anticipatory bail to the petitioner. 6.Accordingly, this Criminal Original petition stands dismissed.
