ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences under Sections 498(A) and 406 of IPC, in Crime No.31 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. The matter was referred for mediation and in spite of best efforts, the parties were not able to reach any settlement. Therefore, the matter was sent back to the Court.
3. Heard the learned counsel on either side and perused the materials placed on record.
4. Taking into consideration the facts and circumstances of the case and also the fact that there is a matrimonial dispute between the parties, there shall be a direction to the respondent police to resort to the procedure under Section 35 of the BNSS and complete investigation as expeditiously as possible and not later than 3 months from the date of receipt of a copy of this order.
5. Considering the fact that the case involves a matrimonial dispute, immediate arrest need not be resorted and the procedure under Section 35 of the BNSS can be followed.
