PRAYER :- For Bail in Crime No.192 of 2022 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioner/ A10, who was arrested and remanded judicial custody on 05.08.2022 for the offences punishable under Sections 302 and 506(ii) @ 120(b),147,148,294(b),302, 506(ii) of IPC in Crime No.192 of 2022, on the file of the respondent police, seeks bail. 2.The case of the prosecution is that on 29.07.2022 when the defacto complainant's son was standing infront of the house and speaking with the fiancee over phone, he was chased assaulted and due to which he succumbed to injuries. Hence the case came to be registered.

3.The learned counsel for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would further submit that no specific overt act has been attributed as against the petitioner https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.17760 of 2022 and he has been implicated as an accused based on the confession given by the co-accused.. He further submits that the petitioner is in judicial custody from 05.08.2022, hence he seeks bail. 4.The learned Government Advocate(Crl.side) appearing for the respondent submits that there are totally eleven accused in this case and the petitioner herein is arrayed as A10. He would further submit that some of the accused were detained under Act.14 of 1982 and it is a case of communal murder. He would further submit that the investigation is at the preliminary stage and if the petitioner is released on bail he will hamper the witnesses. 5.Taking into consideration the gravity of offence and also taking note of the fact that the investigation is at the preliminary stage, this Court is not inclined to grant bail to the petitioner.

6. Hence the petition stands dismissed.
