The instant writ petition has been filed by a retired employee of the respondent Transport Corporation, seeking a Mandamus to incorporate the name of the second wife namely, Kavitha, in the Pension Payment Order as nominee for the purpose of Family Pension and other benefits under the Tamil Nadu State Transport Corporation Employees Pension Fund Rules.
2. The petitioner got divorced from his first wife, namely, one Eswari, by way of an order passed by the III Additional Sub Court, Madurai in H.M.O.P.No.25 of 2008, on 09.09.2009. Thereafter, the petitioner has got married to one Kavitha, on 22.08.2010 and the same has also been registered before the authorities concerned. Thereafter, the petitioner has sent a 2/5
representation to the respondents on 26.06.2024, to incorporate the name of the second wife as a nominee in the Pension Payment Orders. Since the request has not been responded, the present writ petition has been filed.
3. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.
4. Considering the above said facts, the second respondent herein is directed to incorporate the name of the second wife of the writ petitioner, namely, Kavitha as a nominee in the Pension Payment Order of the writ petitioner. The said exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
