This petition has been filed seeking transfer of G.W.O.P.NO. 2803 of 2023 from the file of the II Additional Principal Judge, Family Court, Chennai District to the file of the Family Court Karur. 1/4

2.The facts in brief:

It is a matrimonial dispute between the parties. Both are divorced. The marriage was solemnized between them on 15.04.2014. The respondent has one child through his first marriage. Thereafter, one female child was born to them on 11.05.2018. Later due to misunderstanding and due to cruelty on the part of the respondent, complaint was lodged by the wife, which is pending on the file of the I Additional Mahila Court, Karur in D.V.C.No.58 of 2023. While so, the husband filed G.W.O.P.No.2803 of 2023 before the II Additional Principal Judge, Family Court, Chennai. Now the petitioner is the residence of Karur. It is very difficult to the petitioner to attend the hearing in Chennai. Hence, she filed this petition seeking transfer the above said G.W.O.P. to the file of the Family Court, Karur. 3.Heard the learned counsel for the petitioner. Even though the respondent was served with notice, none appears on behalf of him. His name was also printed in the cause list.

4.Considering the facts and circumstances of the case and considering the convenience of the wife, the G.W.O.P.No.2803 of 2023 filed by the respondent on the file of the II Additional Principal Judge, Family Court, Chennai, is ordered to be withdrawn and transferred to the Family Court, Karur.

5.Accordingly, this transfer civil miscellaneous petition is allowed. Consequently, connected miscellaneous petition is closed. 12.02.2024 NCC :
