ORDER : The Court made the following order :- The petitioner/1st accused, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 341, 394 and 506(ii) of IPC, in Crime No.155 of 2022, seeks anticipatory bail.

2.The case of the prosecution is that the defacto complainant is working as Cashier in the Co-operative Society, Kanyakumari. On 30.09.2022, the petitioner along with other accused abused the defacto complainant, attacked him and also threatened him with dire consequences. Thereafter, they have taken the gold jewels of the defacto complainant. Hence, the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.

CRL OP(MD). No.17767 of 2022 4.The learned Government Advocate(Crl.side) appearing for the respondent police submitted that the injured is still in hospital and the property is not yet recovered and investigation is still pending.

5.Considering the facts and circumstances of the case and also considering the facts that the injured is treated as inpatient and the property is not yet recovered, this Court is not inclined to grant anticipatory bail to the petitioner.
