ORDER : The Court made the following order :- 1/5
The respondent police registered a case as against this petitioner in Crime No.165 of 2025 for the offence under Sections 126(2), 296(b), 118(1) and 351(3) BNS and remanded him into judicial custody on 30.07.2025. Therefore, the petitioner has filed this petition seeking bail.
2.The case of the prosecution is that the defacto complainant's son is doing travels business and there was a business dispute between the defacto complainant's son and A1 in this case. Due to which, the accused persons assaulted him with iron rod and also threatened him with dire consequences. 3.The learned counsel for the petitioner submits that the petitioner is not having any motive as against the victim, however, he has been added as accused. The overt act attributed as against him is that he has pelted stone at the victim. A1 in this case was arrested and released on bail. Further he submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. However, he is languishing in jail from 30.07.2025. 4.The learned Government Advocate(Crl.side) appearing for the respondent opposes for grant of bail on the ground that the petitioner is a notorious criminal 2/5
and he is having six previous cases.
5.At this juncture, the learned counsel for the petitioner submits that the petitioner is ready to file an undertaking affidavit before the concerned Police Station as well as the concerned Magistrate Court that he will not indulge in any offence and he will also provide surety of a respectable person to ensure the same. 6.Considering the above submission and the undertaking, this Court is inclined to grant bail to the petitioner with certain conditions. 7.Accordingly, this Criminal Original Petition is ordered and the petitioner is ordered to be released on bail, i) on the petitioner executing a bond for a sum of Rs.1,00,000/-(Rupees One Lakh) with two sureties each for a like sum to the satisfaction of the Judicial Magistrate Court No.2, Ramanathapuram. The sureties must be a respectful persons in the Society, having a permanent business establishment; ii) The petitioner and the sureties shall submit a copy of their Aadhaar Card or any other identity card issued by the government in 3/5
proof of their residence address;
iii) The petitioner and the sureties shall file an undertaking affidavit before the concerned Police as well as the before the concerned Magistrate Court that he will not involve in any offence in future;
iv) The petitioner shall report before the respondent Police daily twice, ie., morning at 10.30 am., and evening at 05.00 pm., until further orders;
v) The petitioner shall not misuse the liberty granted to him by indulging in any further offence and shall not tamper with the prosecution witnesses. He shall be available for the trial as well; vi) On violation of any of the above conditions by the petitioner, the respondent police shall move an application for cancellation of the bail.
