COMMON ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioners and the learned Additional Public Prosecutor appearing for the respondent.
2.The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 120(b), 406, 420, 468 & 471 of IPC and Section 5 of the Protection of Interest of Deposition (In Financial Establishment) Act, 1997, in Crime No.7 of 2022, seek anticipatory bail.
3.The case of the prosecution is that the first accused is the company called New Raise Alayam Small Financial Banking, having it Regional Office at Karaikudi to provide employment opportunity to the youths. They are in finance business. The first accused and other accused persons were misappropriated huge amount to the tune of rupees four hundred crores. Hence, the complaint. 4.The learned counsel for the petitioners submitted that the petitioners are innocent person and they have been falsely implicated in this case.
5.The learned Government Advocate (Crl.side) made a submission that the allegation of misappropriation of Rupees four hundred crores is under investigation by the respondent Police. The misappropriated amount is yet to be recovered and the earlier petition filed by the other accused persons is pending before this Court.
6. In view of the fact that there is no change in circumstances and the investigation is essential, it is not preferable to consider the present petitions. Accordingly, these Criminal Original Petitions stand dismissed.
