PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus to direct the respondents 1 and 2 to produce the body or person of the petitioner's minor daughter namely, Kaviya, D/o.Bharathi, aged about 17-1/2 years before this Court and hand over her custody to the petitioner.

The mother of the detenue named Kaviya, filed this Habeas Corpus Petition to produce the body of her minor daughter, who is aged about 17-1/2 years.
2. When the matter was taken up for hearing today, the detenu was produced before this Court. We enquired the detenue and she stated that she developed love affair with one Prathap and this was not to the liking of
her mother and it seems that there was some quarrel between the petitioner and her daughter. Hence, the detenu seems to have gone out of the house and she is said to have been taken in a two-wheeler by her boy friend Prathap and was left in some relatives house. Immediately after the complaint was given, the detenu was secured and produced before this Court. The detenu stated that now she wants to go along with her mother.
3. The learned Additional Public Prosecutor submitted that based on the complaint given by the mother, an FIR has been registered in Crime No.290 of 2022 for an offence under Section 366(A) IPC and investigation is pending against the above said Prathap.
