COMMON ORDER The tenants had filed the present civil revision petitions. The landlord had filed the R.C.O.P.No.164 of 2011 for fixing fair rent. The tenant had filed counter and had contested the case, thereafter the Tribunal had fixed the fair rent of Rs. 37,029/-. Aggrieved over the same, the tenant had filed R.C.A.No.6 of 2023 and also had filed two interlocutory applications in I.A.Nos.1 of 2023 and 2 of 2024, for appointment of Advocate Commissioner and seeking permission for adducing evidence respectively. But the said applications were dismissed. Aggrieved over the same, the present Civil Revision Petitions are filed.
2. In order to settle the issue amicably, an attempt was made to compromise between the parties and Mr.Balakrishan was appointed as Mediator. Today, i.e., on 26.09.2024, the 1st petitioner and the respondent have appeared before this Court and they have filed a joint compromise memo.
3. The tenants have agreed to pay the arrears to the tune of Rs.15,00,000/- as full and final settlement and withdraw all the R.C.O.P.s, pending before the Courts and pay the agreed amount of Rs.30,000/- as rent for two months. 2/6
Thereafter vacate the premises on or before 30.11.2024. The tenants also agreed to pay the electricity bill without any arrears. The 1st petitioner, the respondent and the respective Advocates have signed the joint compromise memo. The 1st petitioner has signed on behalf of the 2nd petitioner also. The joint compromise memo shall form part and parcel of the order and decree.
4. Both the Tenant and the Landlord shall pay Rs.10,000/- each to the Mediator.
5. The Civil Revision Petitions are disposed of based on the terms of joint compromise memo. No costs. Consequently, connected miscellaneous petition is closed.
