PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the second respondent to issue Aadhar Card to the petitioner within a stipulated period fixed by this Court.

ORDER

This writ petition is filed to direct the second respondent to issue Aadhar Card to the petitioner.

2.The learned counsel appearing for the petitioner would submit that the petitioner made an application for the aforesaid relief. But, so far no steps have been taken. Hence, the petitioner filed this present writ petition.

3.The learned Special Government Pleader appearing for the respondents filed counter-affidavit, wherein, it has been stated that the petitioner has already enrolled for Aadhar Card as early as on 01.06.2013, which was effectively generated by one P.Sethuramasamy. He also submitted that both the petitioner and the said P.Sethuramasamy were enquired and proper action has been taken for rectifying the defects happened in the year 2013 and to issue the correct Aadhar card to both and the same is under progress.

4.Heard the learned counsel on either side and also perused the materials placed on record.

5. This Court is of the view that the counter affidavit filed by the second respondent in the year 2018, by stating that the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.16922 of 2018 defects happened in the year 2013 will be rectified at the earliest. Even after two years, no progress on the part of the second respondent. Therefore, for issuing the Aadhar card, such an in ordinate delay would not be accepted. The second respondent has to act fastly and issue Aadhar card to the petitioner. Nowadays, the Aadhar card is mostly essential for the citizens to avail any benefit or for opening Bank account or any other purpose etc,. Therefore, the second respondent is directed to complete the process at the earliest and issue Aadhar to the petitioner within a period of twelve weeks from the date of receipt of a copy of this order.

6.This Writ Petition is disposed of, with the above directions. No costs.
