ORDER

In continuation of the order passed by this Court on 24.02.2023, the contempt petitioner [A.S.K.R.Trust represented by its President] and the second respondent in the writ appeal, the President, Sengamalanachiyapuram Panchayat had presented the cancellation deed as well as fresh gift deed covering the present road portion. The documents been registered as Document No.1355/23 and 1356/23 respectively on 27.02.2023. The operative portion of the order of this Court dated 24.02.2023 reads as follows:

"4. Recording the same, the matter is adjourned to 01.03.2023 for reporting compliance regarding cancellation of earlier gift deed and execution of the new gift deed of the land where the new road is proposed and the cost estimation for shifting the electricity pole."

2. Though the first part of the order is complied, namely, cancellation of the earlier gift deed and the execution of new gift deed of the land where the new road is proposed, but the contemnor has not given the cost estimate for shifting the electricity pole. However, over phone, the learned Additional Government Pleader has ascertained from the Block Development Officer that a rough estimate for shifting the electricity police come around Rs.1,10,000/- and the contemnor/respondent will bear it.

3. Recording the same, this contempt petition is closed for the present with hope that the contemnor will shift the electricity police as expeditiously as possible at his cost and if it is not done within a period of four weeks, the contempt petitioner is at liberty to seek for revival of this contempt petition.
