ORDER
This Writ Petition is filed under Article 226 of the Constitution of India seeking for a direction to the respondent police to grant the permission to conduct Aadal Paadal programme on 03.09.2023 in connection with the festival of Arulmighu Shri Maruthambigai Sametha Marutheeshwarar, Shri Periyanayagi Amman and Shri Muneeshwarar Temple Kumbabishega at Govindamangalam Village, R.S.Mangalam Taluk, Ramanathapuram District. 2.It is submitted by the learned counsel for the petitioner that the petitioner and other villagers have been conducting the festival every year including the Aadal Paadal programme, but the respondent police have declined to grant the permission as per proceedings dated 26.08.2023 in Na.Ka.No. 2/5
31/D1PS/Kaa.Aaa./Thiruvadanai/2023 and therefore, sought for suitable directions.
3.Mr.Atham Ali, learned counsel representing one Veerapathiran, intervenor, intents to file an impleading application raising objections for grant of permission to the petitioner.
4.The learned Government Advocate (Crl.side) submits that there are rival groups in the village and the police are prepared to grant the permission for the festival committee, if any of the members of the festival committee cum temple committee approach the respondent police.
5.Considering the submissions made by the learned counsel on either side, this Petition is disposed of directing the respondent police to grant the permission and protection, if necessary, for conducting the temple festival along with Aadal Paadal programme on on 03.09.2023 in connection with the festival of Arulmighu Shri Maruthambigai Sametha Marutheeshwarar, Shri Periyanayagi Amman and Shri Muneeshwarar Temple Kumbabishega at Govindamangalam Village, 3/5
R.S.Mangalam Taluk, Ramanathapuram District, in case if any of the members of the festival committee cum temple committee approaches the respondent police requesting them to grant the permission for conducting the programme. It is also made clear that if any other person other than any of the members of the festival committee cum temple committee approaches the respondent police, the police are at liberty to decline to grant the permission. No costs.
