O R D E R

This criminal original petition has been filed to challenge the First Information Report in Crime No. 347 of 2019 on the file of the first respondent police.

2. On the complaint lodged by the second respondent alleging that on 23.09.2019 at about 8.00 p.m near Kattur Anthoniyar Temple on Trichy - Thanjai main road they found a lorry bearing Reg.No.TN 48 AK 6567 with three units of well soil, a case has been registered by the first respondent. On enquiry it was found that the first accused is the driver of the lorry and the second accused is the owner of the lorry. The complainant verified the permit produced by the first accused and found that it was issued for taking gravel whereas the petitioner transported well soil for his own use. Hence the First Information came to be registered. On the other hand the petitioners filed petition for release of vehicle before the Revenue Divisional Officer and the Revenue Divisional Officer by an order dated 24.10.2019 released the vehicle bearing Reg.No.

TN 48 AK 6567 in Na.Ka.A3/3929/2019. According to the Revenue Divisional Officer the case has been registered only on suspicious ground and only on valid permission the sand was transported. On production of valid https://hcservices.ecourts.gov.

permit the lorry was released by the Revenue Divisional Officer.

Considering the above fact and circumstances of the case and on the strength of the order passed by the Revenue Divisional Officer, the first respondent is directed to complete the investigation and close the First Information Report within a period of four weeks from the date of receipt of a copy of this order.

4. With the above direction, the Criminal Original Petition is disposed of. Consequently connected miscellaneous petitions are closed.
