Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the first respondent to issue passport to the petitioner by considering the petitioner's passport application in File No.MD6065291049725 and consequential explanation offered by the petitioner dated 26.07.2025 within the period that may be stipulated by this court deems it fit and proper in the circumstances of the case.

ORDER

This writ petition has been filed for a writ of Mandamus to direct the first respondent to issue passport to the petitioner by considering the petitioner's passport application in File No.MD6065291049725 and consequential explanation offered by the petitioner dated 26.07.2025.

2. It is noticed that the petitioner has been arrayed as Accused No.2 in an FIR in Crime No.184 of 2017 for offences under Sections 147, 148, 323, 379, 506(i) of the IPC and Section 4 of TNPWH Act, by the second respondent on 06.07.2017.

3. The learned Government Advocate for the second respondent submits that a charge sheet has been filed as early as on 21.08.2017 before the Judicial Magistrate, Nilakottai but the same has not been taken on file till date.

4. Considering the same, there can be no impediment in directing the first respondent to process the petitioner's passport application.

5. Accordingly, the first respondent is directed to process the passport application of the petitioner and issue passport to the petitioner as expeditiously as possible.

6. It is also made clear that in case charge sheet is filed against the petitioner, the petitioner shall voluntarily surrender the passport before the concerned court and retrieve the same as and when the petitioner proposes to travel abroad by filing appropriate application. If the petitioner fails to comply with this condition, the first respondent is at liberty to cancel the passport.
