PRAYER :- For Bail in Crime No.29 of 2022 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.3, who was arrested and remanded judicial custody on 20.09.2022 for the offences punishable under Sections 5(f), 5(1), 5(m) r/w 6(i) of POCSO Amendment Act 2019 and 75 of Juvenile Justice Act (Need Care and Protection Act) 2015, in Cirme No.29 of 2022, on the file of the respondent police, seeks bail.
2.The allegation against the petitioner is that A1 misbehaved with the second daughter of the de-facto complainant with the help of this petitioner.
3.The learned counsel for the petitioner submits that the petitioner is working as a Palvadi Teacher and she does not know https://www.mhc.tn.gov.in/judis 1/2
CRL OP(MD). No.17850 of 2022 about the illegal acts committed by A1 and she is not at all present at the time of occurrence. He further submits that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. He further submits that the petitioner has been falsely implicated in this case.
4.The learned Additional Public Prosecutor appearing for the respondent strongly opposed this petition stating that investigation is not yet completed and 164 of Cr.P.C., statement of the victim girl is yet to be recorded.
5.Considering the gravity of the offence and also considering the facts that the investigation is not yet completed and 164 of Cr.P.C., statement of the victim girl is yet to be recorded, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, the criminal original petition stands dismissed. sd/- 06/10/2022 / TRUE COPY / /10/2022 Sub-Assistant Registrar (C.S.)
