To set aside the judgment and decree dated 06.11.2019 made in A.S.No.22 of 2016 on the file of the Subordinate Judge, Sivakasi, by reversing the judgment and decree dated 12.07.2016 passed in O.S.No.68 of 2009 on the file of the District Munsif, Sivakasi, by allowing this Second Appeal.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.P.SANTHOSHKUMAR, Advocate for the petitioner and Respondent not appeared either in person or by an advocate, the court made the following order:- This Petition has been filed seeking to condone the delay of 12 days in filing the above Second Appeal.
2.Heard the learned counsel for the petitioner and perused the materials placed before this Court. Though notice was served on the respondent and his name being printed in the cause list, there is no representation on behalf of him, either in person or through counsel.
3.Considering the length of delay and the reasons assigned in paragraph No.6 of the accompanying affidavit, this Court is of the view that this petition may be ordered, on payment of costs. 4.In view of the above, this Petition is ordered and the delay of 12 days in filing the above Second Appeal is condoned, however, https://hcservices.ecourts.gov.in/hcservices/ 1/2
CMP(MD) No.10646 of 2021 on condition that the Petitioner/ Appellant pays a sum of Rs.500/- (Rupees Five Hundred only) as costs to the Government Higher Secondary School, Y.Othakadai, Madurai, (Current Account No.10968750674, State Bank of India, Tallakulam Branch, IFSC Code No.SBIN0000253), within a period of one week from the date of receipt of a copy of this order, failing which, this Petition shall stand automatically dismissed, without further reference to this Court.
