Prayer : Criminal Original Petition filed under Section 528 of BNSS, seeking a direction to the respondent Police to complete investigation in Crime No.23 of 2025 and file final report (Charge Sheet) within the time frame fixed by this Court.

ORDER

The petitioner is the defacto complainant in Crime No.23 of 2025 registered on the file of the 2nd respondent Police for the offences under Sections 66C of Information Technology (Amendment) Act 2008 and 78 and 351(2) of BNS. He has filed this petition seeking a direction to the respondent Police to conclude the investigation in Crime No.23 of 2025 and file the final report within a stipulated time.

2. The learned counsel for the petitioner submits that though the case was registered on 27.02.2025, the respondent Police has not taken any steps to conclude the investigation.

3. The learned Government Advocate (Crl. Side) submits that it is matrimonial dispute between the petitioner and the 3rd respondent/husband. The petitioner has already lodged a complaint as against her husband and the same was registered in Crime No.1003 of 2024 on the file of the Thallakulam Police Station, Madurai, for the offence under Sections 296(b), 115(2), 85 and 351(2) of BNS and Section 4 of the Prohibition of Harassment of Women Act. Thereafter, the present complaint has been 2/4

lodged alleging that unknown persons are accessing her google engine, social media, mail ID; her location was stalked and the same was monitored by the 3rd respondent and unknown persons are threatening her and therefore, she is facing threat from the 3rd respondent. Hence, the FIR in Crime No.23 of 2025 has been registered for the offences under Sections 66C of Information Technology (Amendment) Act 2008 and 78 and 351(2) of BNS. The learned Government Advocate (Crl. Side) further submits that a requisition has been made to Apple's iCloud, Bangalore, for receiving IP address, IMEI details and device ID, by a representation dated 12.08.2025. As and when they receive the details from the Apple iCloud, they would proceed further with the investigation and file the final report. Since it is a technical matter, they depend on the report from the Apple's iCloud.
