ORDER

The writ petition is filed seeking a direction to the respondents to issue patta in his favour in respect of the property situated in Survey Nos. 420/7B and 4207C, at Appananallur Village, Thottiyam Taluk, Trichy District by considering petitioner's representation dated 30.06.2025.

2. Heard the learned counsel appearing for the petitioner and Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents 1 and 2.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, the subject property in 4207C originally belong to his father Thangavel. He settled the same in favour of the petitioner under a registered Settlement Deed dated 24.07.2024. Subsequent to the settlement, the petitioner filed instant representation seeking transfer of Patta in his name. The same has not been considered and hence, the petitioner has come before this Court. 2/6

5.Mr.M.Gangatharan, learned Government Advocate, who takes notice for the respondents 1 and 2 on instructions would submit that one Kesavan son of Ganesan, filed a civil suit in O.S.No.101 of 2002 on the file of the District Munsif Court, Musiri, seeking cancellation of sub division in S.Nos.420/7A, 420/7B and 4207C and restoration of S.No. 420/7 in his name and the said suit was decreed. In view of the Civil Court decree, the request of the petitioner cannot be considered.

Since the respondents have taken a definite stand that request of the petitioner cannot be favorably considered in view of the judgment and decree in O.S.No.101 of 2002, on the file of the District Munsif Court, Musiri, to which the petitioner's father Thangavel was also a party, this Court is inclined to direct the 2nd respondent to communicate the decision to the petitioner within a period of two weeks from the date of receipt of a copy of this order. If the petitioner is aggrieved by the ultimate decision of the respondents, it is open for him to challenge the same in the manner known to law.

7. The writ petition is disposed of with the above observations. No costs.
