O RDER This Criminal Original Petition has been filed seeking to quash the proceedings in C.C.No.46 of 2015 on the file of the learned Judicial Magistrate, Tirumangalam, Madurai District.

2.The contention of the petitioners is that based on the complaint lodged by the 2nd respondent, the 1st respondent registered the First Information Report in Crime No.32 of 2014 and filed charge sheet in C.C.No.46 of 2015 on the file of the learned Judicial Magistrate, Tirumangalam, Madurai District for the offences punishable under Sections 498(A), 406 and 506(i) IPC against the petitioners. 3.Today, when the matter was taken up for hearing, the 1st petitioner and the 2nd respondent / defacto complainant are present before this Court and they have been duly identified by the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) for the 1st respondent. On enquiry, the 2nd respondent, who is aged about 42 years and M.Com graduate, has stated that she is not inclined to proceed the criminal proceedings further, knowing fully well about the consequences of withdrawal of the criminal proceedings and she wants to settle the issue out of Court.

5.Considering the totality of the circumstances, the nature of the allegations levelled against the petitioners and also in view of the compromise entered between the parties, this Court is of the opinion that no useful purpose will be served in keeping the matter pending. Hence, all further proceedings in C.C.No.46 of 2015 pending on the file of the learned Judicial Magistrate, Tirumangalam, Madurai District, is quashed in respect of the petitioners.
