This writ petition has been filed for issuance of a writ of Mandamus, directing the respondents to considering the petitioner's representation dated 19.09.2024 and to complete the proceeding initiated by the second respondent in Omu.No.5417/A1/2024 dated 09.11.2024.
2.Heard Mr.H.Arumugam, learned counsel for the petitioner and Mr.S.Vinodh, learned Government Advocate, who accepts notice on behalf of the respondents 1 and 2. Having regard to the nature of the order proposed to be passed in this writ petition, notice to the third respondent is dispensed with.
3. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.
4. The petitioner asserts that her husband was appointed as a Physical Education Teacher in the third respondent school on 01.04.2003. 2/6
Subsequently, he passed away on 04.03.2022. The grievance of the petitioner is that following her husband's demise, she has not received any pension or terminal benefits of her husband till date. In this regard, the petitioner submitted a representation dated 19.09.2024 to the respondents, requesting the disbursement of the pension amount and all other terminal benefits. As no action was taken on the proposal, the petitioner has filed the present Writ Petition before this Court.
5. Learned counsel for the petitioner would further submit that the petitioner would be satisfied if a direction is issued to the respondents to consider the representation of the petitioner dated 19.09.2024 and pass appropriate orders thereon, within a time frame to be fixed by this Court.
6. Considering the above facts and circumstances, without going into the merits of the case, this Writ Petition is disposed of with a direction to the respondents, to consider the representation of the petitioner dated 19.09.2024 and pass appropriate orders in accordance with law. Such exercise shall be completed as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not 3/6
