Respondents Prayer : Contempt Petition is filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondents under the provisions of the Contempt of Courts Act, 1971 for their act of willful violation and disobedience of the orders of this Honourable Court, dated 19.07.2019 in W.P(MD)No.24151 of 2018.

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Mandamus, direct the official respondents to consider the petitioners representation, consequently to direct the 1st & 4th Respondents to demolish the illegal construction carried out by the 5th Respondent and also to direct the 2nd respondent to disconnect the temporary EB connection in the said illegal/unauthorized building and also to direct the 1st Respondent to initiate departmental disciplinary proceedings against the fourth respondent in the Interest of Justice.

O R D E R

(Order of the Court was made by T.S.SIVAGNANAM,J.) The petitioner has filed this contempt petition alleging willful disobedience of the order issued by this Court in W.P(MD) No.24151 of 2018 dated 19.07.2019.

2. Mr.A.K.Baskarapandian, learned Special Government Pleader accepting notice on behalf of the third respondent submitted that notice was issued on 25.09.2019 directing the petitioner and the fifth respondent in the writ petition namely Mr.R.Poongavanam to appear on 03.10.2019. Though the petitioner appeared, the said Poongavanam did not appear and further action will be initiated.

3. It is to be noted that even in the writ petition filed by the petitioner, though notice was served on the said Poongavanam, who was impleaded as fifth respondent, he did not enter appearance. Therefore, the third respondent should not be waiting for his arrival, but, should take action and implement the direction issued by this Court within the time frame stipulated therein.

4. In the light of the above, one more opportunity is given to the third respondent to scrupulously follow the direction issued by this Court. Failing which, stringent action will be initiated against the third respondent.
