For Respondent : Mr.B.Nambi Selvan, Additional Public Prosecutor PETITION FOR BAIL Under Section 439 of Cr.P.C. PRAYER :- For Bail in Crime No.570 of 2022 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioners/Accused Nos.1 to 3, who were arrested and remanded judicial custody on 27.08.2022 for the offences punishable under Sections 6 and 7 of TN Rectified Spirit Rules 2000, Sections 4 (1)(aaa) and 14A of TN Prohibition Act and Sections 420, 468 and 471 of IPC 1860, in Crime No.570 of 2022, on the file of the respondent police, seek bail.

2.The case of the prosecution is that the petitioners were found in illegal possession of liquor bottles and duplicate labels. Hence, the complaint.

No.18001 of 2022 3.The learned counsel appearing for the petitioners submits that the petitioners are innocent persons and they have not committed any offence as alleged by the prosecution. 4.The learned Additional Public Prosecutor appearing for the respondent submits that the first petitioner is a history sheeted person and the petitioners 2 and 3 are having several cases at Kerala. He further submits that if the petitioners are released on bail, there is a possibility of absconding.

5.Considering the seriousness and gravity of the offence alleged as against the petitioners and also the fact that investigation is in initial stage and also considering the bad antecedents of the petitioners, this Court is not inclined to grant bail to the petitioners.
