PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondents 2 and 3 to disburse the professional fees and Court expenses for the petitioner from 01.09.2012 to 30.06.2017 for an amount of Rs.11,30,000/- (Rupees Eleven Lakhs and Thirty Thousand only). ORDER
The writ petition has been filed for a direction to the respondents 2 and 3 to disburse the professional fees and Court expenses for the petitioner from 01.09.2012 to 30.06.2017 for an amount of Rs.11,30,000/- (Rupees Eleven Lakhs and Thirty Thousand only).
2.The petitioner is a practising Advocate and he was appointed as a Special Government Pleader of forest cases in Kanyakumari District, by the first respondent in G.O.(MS).No.110 Environment and Forest (FR-13), Department, dated 21.09.2011. From 21.09.2011 to 22.11.2017, the State Government utilized his service, but his remuneration was not paid. Hence, the petitioner made several representations namely, 03.01.2017, 13.03.2017, 07.07.2017 and 10.07.2017 to the respondents 2 and 3 to disburse the fees for professional and special service of the petitioner. W.P.(MD)No.21992/2019 action has been taken by the respondents 2 and 3 so far. Hence, the petitioner has come up with the present Writ petition. 3.Mr.V.R.Shanmuganathan, learned Special Government Pleader takes notice for the respondents. By consent of both parties, this Writ Petition is taken up for final disposal at the stage of admission itself.
4.Considering the nature of relief sought for in the Writ petition, without deciding the issue on merits, the petitioner is directed to send a fresh representation including the details of the cases conducted by him and the details of fee particulars to the respondents 2 and 3 within a period of two weeks from the date of receipt of a copy of this order. On such representation, the respondents 2 and 3 are directed to consider the representation of the petitioner and pass orders on merits and in accordance with law, within a period of twelve (12) weeks, thereafter. 5.With the above direction, this Writ Petition is disposed of. No costs.
