ORDER

This petitioner has filed this Petition to issue a Writ of Mandamus directing the respondents 1 and 2 to dispose of the Petitioner's Complaint/Representation dated 01.06.2025

2. The learned Additional Public Prosecutor, on instructions, would submit that civil disputes are pending between the petitioner and the third respondent and order was passed by this Court in C.R.P. (MD).No.1520 of 2022 dated 10.12.2024 with a direction to approach the Civil Court.

3. In response, the learned counsel for the petitioner would submit that pursuant to the order passed by this Court, the petitioner came to know that the third respondent has produced forged documents. 2/5

4. The learned counsel for the third respondent would submit that the respondents have no jurisdiction to entertain the complaint.

5. Without going into the merits of the submissions made on either side, there shall be a direction to the first respondent to complete the enquiry, after giving notice to the petitioner and the counter parties, within a period of two weeks from the date of receipt of a copy of this order. It is needless to say that the enquiry would be completed in a fair manner and the result of the enquiry would be in consonance with any orders passed in the civil proceedings. The second respondent can take action only if a cognizable offence is disclosed.

6. With the above directions, this Writ Petition is disposed of. No Costs.
