Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent No.3 and 4 to conduct Survey and demarcate the boundaries of the petitioner's land situated in S.No,602/10, Kunnur Village, Theni District in Patta No. 1100 as per her Challan dated 05.08.2023 in light of the communication of the 2nd respondent in Na.Ka.A6/6126/2023 dated 15,12.2023 by providing adequate police protection. ORDER

The petitioner herein seeks direction to the respondents 3 and 4 to survey the property situated in S.No,602/10, Kunnur Village, Theni District

2. Heard the learned counsel appearing for the petitioner, Mrs.S.Jeya Priya, learned Government Advocate, who takes notice for the respondents 1 to 4 and Mr.M.Vaikkam Karunanithi, learned Government Advocate, who takes notice for the 5th respondent.

3. By consent of both the parties, the writ petition is taken up for final disposal at the stage of admission itself.

4. According to the petitioner, the subject property was purchased by her under a registered Sale Deed dated 19.11.2012 and rectification deed dated 10.12.2012. Patta for the subject property stands in the name of the petitioner in Patta.No.1100. The petitioner submitted an application seeking survey of the subject property on 05.09.2023. However, the same has not been considered. Hence, the petitioner has come before this Court.

5. The learned Government Advocate, who takes notice for the respondents 1 to 4 would submit that the petitioner has not submitted any online application. Hence, her request has not been considered.

6. In view of the same, without expressing any opinion on the merits of the matter, the petitioner is directed to submit an acknowledgment for having filed the online application before the 3rd respondent within a period of 2 weeks from the date of receipt of a copy of this order. 3/6

On production of acknowledgment by the petitioner, the respondents 3 and 4 shall consider her application and pass final orders on its own merits, after issuing notice to the petitioner, 6th respondent, neighboring land owners and other interested parties, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

7. The writ petition is disposed of with the above observations. No costs.
