ORDER

The above application is filed for withdrawing the suit in OS.No.92/2015 pending on the file of VI Additional District Court, Madurai to be tried along with OS.No.540/2015 pending on the file of the IV Additional District Court, Coimbatore.

2. No appearance for the petitioner.

3. A communication has been received from the VI Additional District Judge, Madurai stating that OS.No.92/2015 was originally directed to be disposed of within a period of 6 months by the orders in CRP(MD)No.1551/2021. However, the said suit has been dismissed for default on 06.12.2021. Considering the fact that OS.No.92/2015 stands dismissed, no orders can be passed in the present transfer CMP.

4. Hence, the Transfer CMP is dismissed giving liberty to the petitioner to revive it, if OS.No.92/2015 is restored to file. No costs. Consequently, the connected Miscellaneous Petition is closed.
