PRAYER :- For Anticipatory Bail in Crime No.481 of 2021 on the file of the respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.1, who was arrested and remanded to judicial custody on 07.11.2021 for the offence punishable under Sections 5 and 7 (3) of Lotteries (Regulation) Act, in Crime No.481 of 2021, on the file respondent police, seeks bail. 2.The case of the prosecution is that the petitioner along with the other accused illegally sold the prohibited lotteries. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution, he has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 07.11.2021. Hence he seeks bail to the petitioner. 4.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner is having no previous case and investigation is pending.
5.Considering the facts and circumstances of the case and also considering the fact that the petitioner was in judicial custody from 07.11.2021 and no previous is pending against the petitioner, https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL OP(MD) No.19453 of 2021 this Court is inclined to grant bail to the petitioner subject to the following conditions:
6.Accordingly, the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Ramanathapuram, and on further condition that the petitioner shall report before the respondent police daily at 10.30 a.m. until further orders.
