PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondent to initiate proper action in accordance with law upon the complaint of the petitioner, dated 29.01.2023 vide C.S.R.No.85 of 2023 within a reasonable time to be stipulated by this Court.

This petition is filed under Article 226 of the Constitution of India seeking for a Mandamus to the respondent Police to dispose of C.S.R.No.85 of 2023, dated 29.01.2023.

It is submitted by learned counsel for the petitioner that there are disputes between the petitioner and private person in respect of the immovable property and the said person has cheated the petitioner, thereby, the petitioner has filed a complaint in C.S.R.No.85 of 2023 and the respondent Police have not taken any action, thereby, sought for suitable directions.

3. Learned Government Advocate (Criminal Side), on the other hand, submits that, the enquiry was conducted in C.S.R.No.85 of 2023 and on hearing of both sides, the enquiry in C.S.R.No.85 of 2023 was closed after the undertaking given by the petitioner that he will approach the appropriate forum.

4. Since the petitioner himself has given undertaking that he will approach the appropriate forum and since dispute between the petitioner and the third parties is purely civil in nature, no orders can be passed in this case.
