ORDER

This Criminal Original Petition has been filed seeking a direction to direct the Special Court for Tamil Nadu Protection of Interest of Depositors ( In Financial Establishment) Act, 1997 Madurai to issue certified copy of final report in C.C.No. 11 of 2018 dated 12.11.2018 on the file of the respondent police.

2. The petitioner is one of the accused in C.C.No.11 of 2018 on the file of the Special Court, TANPID Court, Madurai . It is seen that the respondent filed final report in Crime No.1 of 2016 registered for offences under Sections 406,420,120(b) of IPC and Section 5 of TNPID Act, 1997. There are totally 12 accused in this case, in which the petitioner is arrayed as 11th accused. Though the petitioner appeared before the trial court some of the accused did not appear before the trial court and as such the petitioner applied for certified copy of the charge sheet filed by the respondent. It was returned for the reason that when all the accused persons appear before the Court, under Section 207 of Cr.P.C copies will be served.

3. It is seen that the petitioner applied for certified copy of First Information Report and charge sheet in C.C.No.11 of 2018.Therefore the petitioner is entitled for copies under Section 207 of Cr.P.C. and only on the appearance of the accused copies will be served.

4. Therefore the trial court is directed to provide certified copy of the First Information Report and Charge sheet in C.C.No.11 of 2018 to the petitioner.

5. With the above direction, the Criminal Original Petition is disposed of.
