ORDER : This Civil Miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.V.SAKTHIVEL, Advocate for the petitioner and of Mr.M.JERIN MATHEW, Advocate for the 1st respondent and of none appeared either in person or through by an advocate on behalf of the Respondents 1 & 3, the Court made the following order:- This Petition is filed to condone the delay of 75 days in filing the above Civil Miscellaneous Appeal preferred as against the judgment passed in M.C.O.P.No.263 of 2020, dated 31.01.2024, on the file of the Motor Accidents Claims Tribunal/IIIrd Additional Subordinate Judge of Tiruchirappalli and to take the appeal on file. 2.Heard the learned counsel appearing on either side and perused the materials placed before this Court.
3.The learned counsel for the first respondent does not have any serious objection in allowing this Petition.
4.Accepting the reasons stated in the accompanying affidavit filed in support of this Petition, this Petition is allowed on condition that the Petitioner/appellant pay costs of Rs.500/-(Rupees five hundred only) to the credit of the High Court 2/3
Legal Services Committee attached to this Court within a period of two weeks from the date of receipt of a copy of this order.
