Heard the learned counsel on either side.

2. The petitioner joined in B.Tech Agricultural Engineering course in the second respondent institution during the academic year 2018-19. The petitioner attended classes for a month and thereafter left the institution. She had taken back the original certificates. She now wants the tuition fees paid by her.

3. This Court would have granted the relief sought for, if some other student had joined in the place of the petitioner. The second respondent was called upon to file an affidavit in this regard. The Registrar of the second respondent institution had filed an affidavit stating that no such student joined in the place of the petitioner for the academic year 2019-20. When this is the position, this Court cannot grant the relief as sought for. I must place on record that the second respondent has denied the other allegations 2/4
