To permit the petitioner to withdraw the 50 percent of award amount along with the proportionate accrued interest and costs, deposited by the respondent/Appellant to the credit of M.C.O.P.No. 73 of 2020 on the file of the Motor Accidents Claims Tribunal/ III Additional Sub Court, Tiruchirappalli and pass such further or other orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case and thus render justice.

ORDER

This Petition is filed to permit the petitioner to withdraw the 50 percent of award amount along with the proportionate accrued interest and costs, deposited by the respondent/Appellant to the credit of M.C.O.P.No. 73 of 2020 on the file of the Motor Accidents Claims Tribunal/ III Additional Sub Court, Tiruchirappalli

2. The learned Counsel for the petitioner submits that this petitioner is suffering from permanent disability and he is undergoing continuos treatment. Hence, this petitioner seeks permission of this Court to withdraw the 50% of award amount along with the proportionate accrued interest to meet out his medical expenses.

3. The learned Counsel for the respondent has raised objection to allow the present miscellaneous petition.

For the reasons assigned in the accompanying affidavit and on being satisfied with the same, this Civil Miscellaneous Petition is ordered, the petitioner is hereby permitted to withdraw the 50% of award amount along with the proportionate accrued interest and costs, deposited by the respondent/Appellant to the credit of M.C.O.P.No. 73 of 2020 on the file of the Motor Accidents Claims Tribunal/ III Additional Sub Court, Tiruchirappalli.
