The petitioner / accused in CC.No.36 of 2024 on the file of the Fast Track Court, Karaikudi has filed this petition challenging the order dated 19.10.2024 passed in CrMP.No.1711 of 2024. 2.The petitioner has filed a petition in CrMP.No.1171 of 2024 to recall PW1 for the purpose of cross examination. This petition was 1/7
dismissed on the ground that there was no representation for the petitioner for several hearings.
3.This court in order to ascertain the date on which the petition was filed, by earlier order dated 18.08.2025 directed the petitioner to furnish the dates and events in CrMP.No.1171 of 2025. The petitioner has not placed any materials before this court to substantiate the reason for his non-appearance for several hearings. He has furnished the details obtained from e-court services with regard to CC.NO.36 of 2024 and the same is extracted as under:

4.From the above proceedings this court is not in a position to understand as to the date of filing of the petition in CrMP.No.1171 of 4/7
2024 by the petitioner. The petitioner claims that he had filed the said petition on 11.06.2024. Thereafter the case was posted on 25.06.2024, 05.07.2024, 17.09.2024, 01.08.2024, 16.08.2024, etc., It was posted for questioning on 19.10.2024, 11.11.2024 and on 26.11.2024. The petitioner did not appear. Therefore, a non bailable warrant of arrest was issued as against the petitioner on 17.12.2024 and it was posted on 26.02.2025, 19.03.2025 and 23.04.2025 as service pending - NBW. 5.According to the learned counsel the petitioner has filed the said petition on 11.06.2024. It is seen the matter has been adjourned to 25.06.2024, 05.07.2024, 19.07.2024, 01.08.2024, 16.08.2024 and to 17.09.2024 and finally it was dismissed on 19.10.2024. The petitioner has challenged the order dated 19.10.2024 in the month of August 2025. 6.Considering the manner in which the proceedings has been dragged on by the petitioner, this court is not inclined to entertain this petition. Accordingly, this petition is dismissed. Consequently connected miscellaneous petition is closed.
