O R D E R
This Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the respondents 1 and 2 to pay compensation to the petitioners for unlawfully damaging the shed put up the forest land and haystack in Sy.No.271, Keelaiyur Village, Alangudi Taluk, Pudukottai District and to take action against the respondents 6 and 7 for unlawful damaging the cattle shed taking advantage of their official power by considering the petitioners' representation dated 14.08.2023.
2. The grievance of the petitioners is that the property in Sy. No. 189/22A, Keelaiyur Village, Alangudi Taluk, Pudukottai District, belongs to the first petitioner. The Forest Planning Officer, Aranthangi, vide proceedings dated 21.09.1979, recommended that the Government allot 80 cents of land to the petitioners' ancestors by classifying the same as Natham Poramboke. Thereafter, the petitioners' ancestors were in possession and enjoyment of the property. Subsequently, the respondents 6 and 7 damaged the property of the petitioners 2 to 6. The petitioners later came to know that the said acts were committed to lay an unlawful 3/6
pathway/road for the benefit of the eighth respondent. Hence, the petitioners sent a representation to the second respondent seeking action against the erring officials. Since no action was taken by the second respondent, the first petitioner filed a suit in O.S. No. 52 of 2023 on the file of the Munsif and Judicial Magistrate Court, Alangudi, seeking a permanent injunction. During the pendency of the said civil suit, the petitioners 3 and 4 filed another suit in O.S. No. 57 of 2023 on the file of the Munsif and Judicial Magistrate Court, Alangudi, seeking the same relief. Thereafter, respondents 6 and 7 again damaged the property of the petitioners by laying a road. The petitioners then submitted a detailed representation to respondents 1 to 5. Since no action has been taken by the official respondents, the present writ petition has been filed.
3. The learned Special Government Pleader appearing for the respondents 1 to 5 submitted that civil suits are pending before the Munsif and Judicial Magistrate Court, Alangudi. Hence, the parties may be advised to approach the civil Court.
4. Recording the same, this Writ Petition stands disposed of with a direction to the petitioners to seek remedy before the civil Court. There shall be no order as to costs. Consequently, the connected writ miscellaneous petition is closed. 4/6
