ORDER
By consent, the Writ Petition is taken up for final disposal at the admission stage itself.
2. This Writ Petition has been filed seeking a direction to the respondents 2 and 3 to act expeditiously, ensure the safety and well-being of the petitioners from the fourth respondent, and consequently, to fix the monthly maintenance payable to the petitioners.
3. The learned counsel for the petitioners submits that the petitioners are octogenarians, aged about 82 and 77 years, respectively. It is submitted that the fourth respondent, who is the second son of the petitioners, is troubling them.
4. It is further submitted that the first petitioner is a pensioner and has undergone open-heart surgery, while the second petitioner has undergone multiple surgeries and is suffering from age-related health issues.
5. It is alleged that the fourth respondent is harassing the petitioners, demanding the pension amount, and is also threatening to reside with them against their wishes.
6. It is noted that the petitioners had initiated proceedings before the second respondent / Revenue Divisional Officer, Nagercoil, on 07.07.2025. However, no action has been taken so far. The concerns raised by the petitioners warrant immediate attention from the second respondent.
7. Considering the above said facts and circumstances of the case, this Writ Petition is disposed of, dispensing with notice to the fourth respondent, by directing the second respondent to dispose of the petitioners' application dated 07.07.2025, on merits and in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. Needless to state, the petitioners and the fourth respondent shall be afforded an opportunity of personal hearing before passing final orders.
8. Pending such final decision, the second respondent is also directed to conduct an enquiry through his subordinates and pass any appropriate interim order that may be necessary to protect the interests of the petitioners.
