To prefer the above Memorandum of Grounds of Second Appeal against the Judgement and Decree passed in A.S.No.220/2005 dated 19.01.2006, on the file of the 1st Additional Subordinate Judge, Madurai, reversing the judgment and Decree passed in O.S.No.507 of 2004, dated 19.09.2005, on the file of the District Munsif Court, Tirumangalam.
ORDER : This petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/s.J.PADHMAAVATHI DEVI, Advocate for the petitioner in all the Petitions and of M/s.M.D.DEVI SARAVANAPRIYA, Advocate for Mr.PT.S.NARENDRAVASAN, Advocate on behalf of the Respondent in all the Petitions, the court made the following order:- These applications have been filed seeking to condone the delay of 5713 days in filing the application to set aside the abatement caused due to the death of the first appellant Periyakaruppan in the second appeal, to set aside the abatement caused and to bring on record the petitioners 4 to 8 as legal heirs of the deceased first appellant and rank them as appellants 4 to 8 in the Second Appeal.
2. Heard the learned counsel appearing for the petitioners. The learned counsel appearing for the respondent has no objection for allowing these applications.
3. Considering the reasons assigned in the affidavit filed in support of the application, the delay of 5713 days is condoned on condition that the petitioners pay a sum of Rs.5000/- (Rupees Five Thousand only) to Mrs.M.D.Devi Saravanapriya, Advocate, within a period of two weeks from the date of receipt of a copy of this order, failing which, the petition shall stand dismissed automatically without further 3/5
reference of this Court. Consequently, connected applications to set the abatement and to bring record the legal heirs of the deceased are also allowed.
4. The Registry is directed to carryout the necessary amendment in the second appeal and post the matter after two weeks.
